Bankruptcy is a legal procedure that assists a financially troubled business in dealing with its financial problems. There are two main types of business bankruptcies - Chapter 7, which results in a liquidation of all assets, and Chapter 11, which may result in reorganization or liquidation. Consumers have significant legal protection against abuses by creditors and debt collectors. Under the law, a creditor or debt collector may not use profane, obscene or abusive language. A debt collector or creditor may not telephone you at work unless they have been unable to reach you at your residence during the proceeding thirty (30) day period. If you have fallen behind in your mortgage payments you may find that your lender will start legal proceedings against you. This procedure is called mortgage foreclosure and is the lender's way of getting possession of your house to protect the money they have loaned you. Remember, the lender does not really want your house but it does want the payments to be made. Bankruptcy is a legal procedure that assists financially troubled individuals in obtaining a fresh start. There are four types of personal bankruptcies. They are Chapter 7 liquidation; Chapter 13 repayment over time either in whole or in part; Chapter 11 for individuals, and Chapter 12 family farmer. You have the right to know what is contained in your credit file. If you have been denied credit, employment or insurance within the last sixty days, the Credit Bureau must show you your complete credit file at no charge to you. Even if you have not been denied credit, employment or insurance, you have the right to see your complete credit file at a reasonable charge. Co-signing on a contract to obtain a loan or to purchase goods on installment payment is a simple act. However, that act of signing your name on the loan agreement or contract next to or under the signature of the person entering into the contract could have serious legal repercussions for you in the future. Most people finance the purchase of their truck or automobile. In most cases, the consumer enters into a loan agreement which allows the consumer to pay for the vehicle over time and gives the lender a "security interest" in the vehicle. The security interest gives the lender the right to repossess the vehicle if the consumer breaches the agreement with the lender.
