HOW TO GET MARRIED

A Marriage License is necessary before you can become married in Pennsylvania, except in Common Law Marriage cases which are discussed in Tel-Law message "Common Law Marriage." In order to apply for a Marriage License, both parties must appear in person at the Marriage Bureau which is located in Room 123 in the West Wing of Erie County Court House, or go to any Court House in Pennsylvania.

There is a $45 filing fee for a marriage license and the Erie County Marriage Bureau can only accept CASH for this fee. A premarital blood test or physical is no longer required in Pennsylvania. When you appear, you should have with you the following information:
1. Your Social Security Number and the address where you currently reside.
2. Your mothers’ maiden names.
3. Your parents’ current addresses.
4. The state where your parents were born.
5. Your parents’ occupations.

If either applicant is divorced, or divorced more than once, you must bring in your Divorce Decree(s). If the woman has resumed her maiden name after a divorce, she must submit proof of resuming her maiden name. If a prior marriage was terminated by death, you will need to provide a date of death of the spouse.

There is a three-day waiting period between the application and the issuance of a license. Either applicant can pick up the license after the three-day waiting period.

The license is valid for 60 days from the date of issuance and it can only be used in Pennsylvania.

Non-Pennsylvania residents may also secure a license from the Marriage Bureau in the Erie County Court House, but the license can only be used in Pennsylvania.

If either applicant is under 18 years of age, consent of the custodial parent or guardian is necessary. The applicant’s original Birth Certificate is required. There will be an additional $10 fee for each underage applicant.

If either applicant is under the age of 16, the consent of the Court must be obtained. Persons qualified to perform the marriage ceremony include Judges, Magisterial District Judges, Mayors of any municipality or borough and members of the clergy.

It is sometimes necessary to obtain copies of your marriage license for retirement and pension, a name change, state identification or for Social Security. To obtain a copy of your marriage license, if you are in the Erie area you may go to the Marriage Bureau in the Erie County Court House. The office hours are 8:30 a.m. to 4:15 p.m., Monday through Friday (except holidays).

If you request a copy by mail, you must send the following information:
1. The date of marriage.
2. The groom’s full name.
3. The bride’s first name, maiden name, or previous married name.
4. A check made payable to the “Clerk of Records” for the number of copies you are requesting at $5 each.
5. A self-addressed, stamped envelope so these copies can be returned to you.
