THE PROGRAM
The onset of the novel coronavirus, COVID-19, at the beginning of 2020, disrupted the global economy as a result of actions by private business, employees, customers, and government regulators, taken to combat the pandemic. Events have been canceled or delayed. Contracts for goods and services have been breached. How are force majeure provisions in these contracts interpreted? What happens if a contract is silent? How should contracts be drafted or revised to prepare for a potential “second wave”?
