Lines in the Sand: When a family law matter washes up on the shore of bankruptcy, the lines drawn by the dueling parties can often get washed away in an instant by the tide of litigation.
Come and join this interesting seminar and learn what happens when a bankruptcy is filed in the midst of a divorce: What happens in the competition between state and federal law? What is the extent of the Bankruptcy Court’s power with respect to a matter involving state court law pending in the State Court? Does the concept of “property of the estate” trump that of “equitable distribution”? For both the bankruptcy and family law practitioner to learn what to do when your client (or the other party) makes bankruptcy a part of your case.
Among other topics, this seminar will cover: basic bankruptcy information that the family law practitioner needs to know; a brief review of bankruptcy code sections that affect divorce and support matters; bankruptcy motions and applications that can affect family law practitioners.
