If your application for benefits is denied, you may file a request
for a hearing within sixty days from the date of the denial.
At this level, your case will be set for a hearing before an
Administrative Law Judge. This is the only step in the appeals
process where the person that
actually decides your case has an opportunity to see you, speak
with you, and review evidence
relative to your disability. Your request for a hearing may be
filed by you at the local Social
Security Office. If, as a result of your hearing, the Administrative
Law Judge determines that you
do not meet the requirements establishing a disability, then
you may file a request for review of
that hearing decision within sixty days of the date that you
receive the Judge's written denial of
benefits. This request for review may be obtained and later filed
at your local Social Security
Office.
Your case will then be reviewed by the Appeals Council of the
Office of Hearings and
Appeals in Falls Church, Virginia. If the Appeals Council ultimately
denies your request for
review, you may then obtain a court review of the Administrative
Law Judge's decision by filing
a civil action in the United State District Court within sixty
days from that date that you received
a denial of your request for review or final decision from the
Appeals Council.
