MAIL ORDER PROBLEMS

There are many legitimate mail order companies, but there are many fraudulent ones as well. If you are planning to purchase a major item from a mail order company you should check on the company's reputation by calling the Better Business Bureau in the city of state where the company is located. The Better Business Bureau will be able to tell you how long the company has been in business, whether there have been a significant number of complaints and whether the company has resolved these complaints. You have a right to receive the merchandise within the period of time promised by the seller. If no such period is set for delivery, you have a right to expect delivery within four (4) weeks. If the merchandise is not delivered to you on time, the company has a duty to contact you and offer you a choice of a refund or a new delivery date.

If you receive merchandise in the mail which you did not order, you have no duty to return it or to pay for it. Unsolicited merchandise which has not been ordered by anyone in your household may be considered by the recipient as a gift. If you continue to receive bills for such merchandise, you may file a complaint with the Pennsylvania Bureau of Consumer Protection. The Bureau's northwestern Pennsylvania office is located in Erie. Many mail order companies use contests or promotion to promote sale of their product. A company cannot legally require you to purchase something in order to participate in a contest.

Beware of companies who have told you that you have won a free prize. Make sure that the free item will not cost you anything. If a company is genuinely giving you a prize or a gift, you should not have to pay postage, handling or a redemption fee to claim that prize. This is a common tactic used by fraudulent operators. If you believe that you have been the victim of mail fraud, you should contact the United States postal inspectors and the Pennsylvania Bureau of Consumer Protection immediately.
