Representation is provided in civil matters only. Low income individuals with criminal
problems are represented by the Public Defender’s Office. Legal Services handles no real estate
matters and also does not provide representation in any case where a private attorney could
receive a fee at the successful conclusion of the case, such as personal injury matters or Social
Security Disability claims. Representation is provided only to those who would otherwise be
unable to afford or obtain an attorney.
The types of cases handled by Legal Services include problems concerning welfare
benefits, unemployment compensation, Supplemental Security Income, landlord/tenant problems,
mortgage foreclosure, domestic violence, defense of child custody cases, education problems and
some consumer matters.
Instructional clinics are also offered for those wanting to file their own custody action and
also uncontested divorces if there are no property issues involved.
If an applicant is both low income and has the type of problem which the office can
handle, an appointment will be scheduled where the client will meet with a Legal Services
attorney. Appointments are required. In addition to representation provided by its own staff,
Legal Services also works with the Erie County Bar Association to refer low income clients to
the Bar Association’s volunteer attorney program where private attorneys provide free
representation to eligible clients. Eligibility for this program is also determined by the Legal
Services office.
